1. Acceptance of Terms
By accessing and using NurseConnect Australia ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.
2. User Accounts
To access certain features of the Platform, you must register for an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information to keep it accurate and complete
- Maintain the security of your password and accept all risks of unauthorized access
- Immediately notify NurseConnect of any unauthorized use of your account
3. Professional Credentials
For healthcare professionals using the Platform, you represent and warrant that:
- Where your profession requires it, you hold current and valid AHPRA registration and will not apply for roles that require registration you do not hold
- All qualifications, certifications, and credentials you provide are accurate and current
- You will immediately notify NurseConnect of any changes, suspensions, or conditions applied to your registration or credentials
- You hold, or will arrange, appropriate professional indemnity insurance for any role where the engaging facility does not provide cover — it is your responsibility to confirm coverage arrangements with the facility before accepting a shift
4. Right to Work in Australia
By registering and using NurseConnect as a healthcare professional, you represent, warrant, and acknowledge that:
- You have the legal right to work in Australia and are entitled to accept employment or engage in work for the duration of any shift booked through the Platform
- You are not subject to any visa condition, work restriction, or legal prohibition that would prevent you from lawfully performing the work arranged through the Platform
- You will immediately notify NurseConnect if your right to work in Australia changes, expires, or becomes subject to any restriction at any time while your account remains active
- You accept sole responsibility for ensuring your ongoing compliance with Australian immigration law and any conditions attached to your visa or work entitlement
- NurseConnect may verify your right to work status at any time and may suspend or terminate your account if satisfactory evidence cannot be provided
Providing false or misleading information regarding your right to work is a serious breach of these Terms and may result in immediate account termination, as well as referral to the relevant authorities where required by law.
5. Background Checks & Screening
Many healthcare roles involve working with vulnerable people, including children, elderly individuals, and people with disability. You represent and warrant that:
- You hold a current Working with Children Check (WWC) or Working with Vulnerable People (WWVP) check where required by the role or the state/territory in which you are working
- Where a role involves NDIS participants, you hold a current NDIS Worker Screening Check and are not a prohibited person under the NDIS Worker Screening Act 2020
- You will disclose any criminal history, pending charges, or disciplinary findings that may affect your suitability for a role when prompted during registration or document verification
- You will not accept or commence a shift for which you do not hold the required screening clearances
- NurseConnect may request evidence of screening checks at any time and may suspend your account pending verification
It is your responsibility to understand and comply with the screening requirements applicable to each role and jurisdiction. NurseConnect does not guarantee that all screening requirements are captured in shift listings and encourages you to confirm requirements directly with the facility.
6. Conduct Standards
When working shifts arranged through the Platform, you agree to:
- Arrive on time and fulfil the full duration of any shift you have accepted, except where withdrawal is due to a genuine emergency or medical incapacity
- Notify the facility and NurseConnect as early as possible if you are unable to attend a confirmed shift
- Conduct yourself professionally and in accordance with the standards expected of your profession and the policies of the engaging facility
- Not solicit or accept direct bookings from facilities or contacts met through the Platform for a period of 12 months after your last Platform-facilitated booking with that facility, unless agreed in writing with NurseConnect
- Not engage in any conduct that is discriminatory, harassing, or harmful to patients, facility staff, or other platform users
Repeated no-shows, late cancellations, or conduct complaints may result in account suspension or termination. Facilities may also submit conduct reports which NurseConnect may take into account when reviewing your account standing.
7. Platform Usage
You agree not to:
- Use the Platform for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to any portion of the Platform
- Interfere with or disrupt the Platform or servers/networks connected to it
- Upload or transmit viruses or any other type of malicious code
- Collect or harvest any personally identifiable information from the Platform
8. Shift Bookings and Payments
Pay rates are set by the facility and displayed on each shift listing. By accepting a shift you agree to the rate shown.
NurseConnect acts as a payment intermediary. Once a completed shift is confirmed, NurseConnect will pay you directly and separately invoice the facility for the shift amount plus NurseConnect's service fee. You do not need to chase the facility for payment — that is NurseConnect's responsibility.
Payment to workers will be made within the timeframe communicated during onboarding. NurseConnect reserves the right to withhold or delay payment where:
- The shift completion is disputed by the facility and is under investigation
- Your account is suspended or under review for a breach of these Terms
- Valid banking or payment details have not been provided
NurseConnect is not your employer. Workplace conditions, safe work obligations, and the terms of your engagement remain the responsibility of the facility. NurseConnect's payment intermediary role does not create an employment relationship.
Cancellations are subject to the following:
- Cancellations made more than 24 hours before a shift starts will not incur a penalty
- Cancellations made within 24 hours of a shift start, or failure to attend without notice (a no-show), may result in a warning, temporary suspension, or account termination depending on frequency and circumstances
- Facilities may also cancel shifts. Where a facility cancels within 4 hours of the shift start, NurseConnect will use reasonable efforts to notify you promptly, but accepts no liability for losses arising from a facility cancellation
9. Disputes
Payment disputes: Because NurseConnect processes all payments, any dispute about pay for a completed shift must be raised with NurseConnect directly — not with the facility. Contact us within 14 days of the shift end date. NurseConnect will investigate and, where the claim is valid, arrange payment within a reasonable timeframe.
Workplace disputes: Disputes regarding working conditions, conduct, or the terms of your engagement at a facility are primarily a matter between you and that facility. NurseConnect is not your employer and does not arbitrate employment disputes.
NurseConnect may, at its discretion:
- Facilitate communication between a worker and a facility to help resolve a dispute informally
- Investigate conduct complaints made by either party and take action (including suspension or removal) where a breach of these Terms is found
- Suspend access for either party during an investigation to protect the integrity of the process
For unresolved workplace disputes, workers may contact the Fair Work Ombudsman at fairwork.gov.au or seek independent legal advice.
10. Intellectual Property
The Platform and its original content, features, and functionality are owned by NurseConnect Australia and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
11. Limitation of Liability
To the maximum extent permitted by law, NurseConnect Australia shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.
Where liability cannot be excluded by law, NurseConnect's total liability to you for any claim arising out of or related to these Terms or your use of the Platform shall not exceed the total platform fees paid by you to NurseConnect in the 12 months preceding the event giving rise to the claim.
NurseConnect is not liable for the acts, omissions, or conduct of any facility or worker, including but not limited to non-payment of wages, unsafe working conditions, or failure to hold required credentials or clearances.
12. Termination
We may terminate or suspend your account and bar access to the Platform immediately, without prior notice or liability, at our sole discretion, including where you breach these Terms of Service.
Where your account is terminated:
- Any upcoming confirmed shifts will be cancelled and the relevant facilities notified
- You remain liable for any obligations (including conduct or payment obligations) that arose prior to termination
- NurseConnect will retain records as required by law or for legitimate business purposes in accordance with our Privacy Policy
You may also close your account at any time by contacting us. Voluntary closure does not affect any outstanding obligations.
13. Changes to Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Continued use of the Platform after changes become effective constitutes acceptance of the revised Terms.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law provisions.
